Terms of Service
Agreement to Terms
By accessing bytrendwise.com or engaging Trendwise Media (“Company,” “we,” “us,” or “our”) for any services, you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you (“Client”) and Trendwise Media.
Services Rendered
Trendwise Media provides the following digital services:
- Social media management and content creation
- AI-powered website design and development
- Paid social advertising (Meta, TikTok, and other platforms)
- Brand strategy and identity development
- Influencer marketing campaign management
- Email marketing and digital consulting
Specific deliverables, timelines, and pricing are outlined in individual service agreements, proposals, or order confirmations provided prior to the start of work.
Payment & Retainer Terms
Monthly retainer services are invoiced at the beginning of each billing cycle. One-time project fees require a deposit before work commences, with the remaining balance due upon completion. Payments are processed securely via Stripe or other payment processors.
By providing payment information, you authorize us to charge the agreed amounts on the schedule specified. Late payments may result in suspension of services. All fees are non-refundable unless explicitly stated in a written agreement.
Client Responsibilities
You agree to provide timely feedback, approvals, and any assets, credentials, or information required to complete the work. Delays caused by the client that impact project timelines do not entitle the client to a refund or service credit.
You represent that you have all necessary rights to any materials, content, or brand assets you provide to us, and that our use of those materials will not infringe any third-party rights.
Intellectual Property
Upon receipt of full payment, the client owns all final deliverables created specifically for their brand. Trendwise Media retains the right to display completed work in its portfolio, case studies, and marketing materials unless the client submits a written request for confidentiality within 14 days of project completion.
Trendwise Media retains ownership of all proprietary tools, methodologies, templates, and processes used in delivering services.
Confidentiality
Both parties agree to keep confidential any non-public, proprietary, or sensitive information disclosed during the engagement. This obligation survives the termination of the agreement. Confidentiality does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
Limitation of Liability
Trendwise Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claims arising from these Terms shall not exceed the total fees paid by you in the three (3) months preceding the claim.
Cancellation & Termination
Either party may terminate an ongoing service agreement in accordance with the terms outlined in our Cancellation & Refund Policy. Upon termination, all outstanding balances become immediately due and payable. We reserve the right to terminate services immediately if a client engages in abusive, fraudulent, or unlawful conduct.
Governing Law
These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation and, if unresolved, through binding arbitration.
Changes to Terms
We reserve the right to update these Terms at any time. Changes become effective upon posting to our website. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
